Re:Criminal record and Tier 2 application

  • Hi all
Need urgent advice from you all. I am working in UK on WP, and getting expired in Feb. Now my employer is applying for me under Tier 2.
However, In June 2008, I was caught with shoplifting. Police told me that I'll be left with caution only. I was taken my DNA samples etc. but they said this case won't go to court. However, they told me that I'll have criminal record and my record will be there in PNC for two years. I am not sure whether its called Criminal conviction. I got a letter from police, which I tore immediately, stating that I have some criminal case or something like that, and police records will be maintained for 2 years.
    1. Do I need to mention in the application that I was criminally convicted?
    2. Shall I mention in the section on any incidents to find about the character?
    3. If I don't mention anything, will Home office finds info this from PNC?
    4. If I mention or if home office comes to know, is there any chance of me getting the Tier 2 visa.
I know its a laundry list, but your advice, suggestions are greatly appreciated.
    Thanks and Regards
    Ramesh
