Spouse Visa

I don't know where to start. I am married to a British Citizen and am not going to mail my documents in until a week and a half from now. What is the longest it will take if I hit peak time? They say 5 to 10 business days, but I am still worried. How strict is the UK embassy? MY husband and I don't have savings, but he is employed and we are not seeking public funds. Do I have a chance?

Hi,
I am married to non UK Citizen, a settlement visa has been applied for, and a decision was reached in 2 weeks, but refused, because the ECO thought that we got married quickly, we met online Jan 08, I flew to her 1st March 08, got married just before I left to start a new job in UK, we have appealed to the ECM and are now awaiting a decision, the other reason for rejection was that my wife does not work and has no finances, I have written a 4 page letter and also my wife has written a letter and suppllied bank statements which proves that she does not work or receive funds except from me. Has anyone had this same reason fro refusal? Also any help would be gratefully appreciated.

Hello pls i need help and advise
My name is charles and am from nigeria, i am married with a romania citizen. she as gotten a job in the UK for the past 2-3 weeks but waitting for me so we can both go together to start work and new life there.
We going to the UK embassy next week and we have filled the form for EEA FAMILY permit for a year but am scared because i wrote there i get some supports from my family and maybe they might not give me cus of that. But i also got some interviews for jobs and some letter comfirming they will get me a job when i get to the uk, I just want to know if i should re-fill the form or just go like that?
someone should help me fast with what i should do and the things i need to take along to the embassy.

My wife have a criminal record in Russia
I am UK citize, was born in UK. My wife lived with me 1 year in London and then returned for a 3 months to Russia. And it was happened, that her boss didn't pay her money and she stole this money ( about 3000 pounds), when it was opened she returned all money back during 3 weeks. But the court sent her to a prison for 3 years. She was release after 2.4 years and now she applied for visa. But the UK Embassy refused. Now we are preparing an appeal witj a lawyer, but I am very worring. Pleaae give any additional advice.

HELP!
My mum and I moved to england in 1998 with my father on a work visa. the visa ended in 2005 and we went back to the USA for 4 months where my mum and dad divorced and my mum married a british citizen. We came over on a spouse/dependant visa in 2006 and the visa expired in march. We want to renew but unsure if we'll be allowed. Will we be ok? I'm 19 now so most of my life has been here.

Hi All,
Hopefully I will be going to get married this summer. My future wife holds a pakistani passport and National Identity Card (NIC)with her father name. Is it true once we get married she has to re apply for both using my name (husband) in order to apply for a spouse visa?

hi,
i am a pakistani passport holder and am married to a norwegian citizen whi works in UK. i initially went to norway in 2005 and spent six months there. my husband used to work in uk before our marriage then he moved to norway and worked there for some time and sponsored me, in 2005 he came back to uk. i joined him by obtaining EEA spouse visa from British High Commission oslo norway. after a year i embarked on a study course and obtained a student visa. now i want to live and work in uk permenantly. i have the right to apply for EEA family permitt under EEA law. i want to know that as i have lived in the uk with my husband for 3 years and we have been married for 4 years, can i apply for EEA family permenant residence?. i had permenant residence in norway but before stamping the indefinite leave to remain , norwegain immigration authorities advised us to seek non-EEA family member of EEA citizen in the uk. please advice me accordingly. my husband has been self employed. what documents do we need to present as proof of his employement? thanksrabia 15 Jun 2008, 10:59 - Report -

My wife is a British citizen, born in the UK. If I join her there on a spouse visa and then get divorced, am I able to stay for the rest of the two years of the visa? If not, how will they know? (ie is it self-reporting?)

EEA Family Permit and Spouse Visa
I am a non-EU, Permanent German Resident married (2 years) to a British Spouse living with me here in Germany. I have have EEA Family Permit(on her sponsorship). Can I apply for British citizenship after 2 or 3 years in the UK based on my marriage and the Residence Card? Must I change my Visa category to Spouse Visa (Immigration rule)before this can be eff ective. I am at a conspicuous disadvantage in my career paths due to my nationality: (German nationality is second to British citizenship in my opinion). Therefore, kindly hint my the easiest and time-effective legal path to attaining Brirish citizenship.

INFORMATION AND ADVICE
The requirements to be met by a person seeking leave to enter the United Kingdom with a view to settlement as the spouse or civil partner of a person present and settled in the United Kingdom or who is on the same occasion being admitted for settlement are that:
(i) (a) the applicant is married to or the civil partner of a person present and settled in the United Kingdom or who is on the same occasion being admitted for settlement; or
(b)(i) the applicant is married to or the civil partner of a person who has a right of abode in the United Kingdom or indefinite leave to enter or remain in the United Kingdom and is on the same occasion seeking admission to the United Kingdom for the purposes of settlement and the parties were married or formed a civil partnership at least 4 years ago, since which time they have been living together outside the United Kingdom; and
(b)(ii) the applicant has sufficient knowledge of the English language and sufficient knowledge about life in the United Kingdom, unless he is under the age of 18 or aged 65 or over at the time he makes his application; and
(ii) the parties to the marriage or civil partnership have met; and
(iii) each of the parties intends to live permanently with the other as his or her spouse or civil partner and the marriage or civil partnership is subsisting; and
(iv) there will be adequate accommodation for the parties and any dependants without recourse to public funds in accommodation which they own or occupy exclusively; and
(v) the parties will be able to maintain themselves and any dependants adequately without recourse to public funds; and

hello there,

Criminal Convictions
Hi there i am a british citizen and i have been married to my husband who is an asylum seeker for over years now.ever since i have been trying to bring my husband to live with me to the UK but the home office refused as they said he must return to home country and apply for a visa there.So i went to high courts and luckly won the case now we have handed in all relevant documments and application to visa centre. My husband can not return to home country because he has a minor conviction which is to do with racial discrimination against my husband. Unfortunately the home country has ststed it as Criminal do you guys think this will affect out application? and if yes how? anyone ever been in the same situation? help please.

Just to add to my previous quotes, im also now over 4 months pregnant and want to have my baby in the UK i want my husband present with me in labour i have told the embassy this. i currently have two jobs and qualifications. what do u guys think my chances r of my husband geting the visa ? please could someone reply as im feeling really depressed. im pregant and i fear my babies health if it goes on like this

The High Court Lord Justices who sat and passed the landmark and generous ruling in Chikwamba v SSHD [2008] UKHL 40 - stating that the spousal visa should be made in country - there was no reason for the asylum seeker wife to go back to country of origin to aapply for a visa.
I hope this case will also apply to you.

thanks a million for that but we have already got the case i mean the home office decided that my husband does not need to go to home country to make a application due to his asylum.
i still waiting for a decision from the embassy but still no news
i wanted avdice on weather my husbands criminal conviction will be a bad impact to our visa??? as i said the home country stated it as a assualt but we argue that it was a racial descrimination and not assualt. there are so many similar cases to ours in the home country.
my solicitor has said this shouldnt be a problem. has anyone been in the same situation? if yes please advice and give info as im stressing. im preganant and i think im going to go under depression because of this.

You had to apply for the indefinite leave to remain with the home office from 3 months at least before your visa expires. You must seek some legal advice or call the home office as soon as possible otherwise the home office may just extend your visa for another 2 years.

Students are not that BAD
Hi!
First of all all students or ppl on spouse visa are not that bad. In my opinion its mistake of both parties.
Anyway help I am asking for is, I am student in UK and got married back in Pakistan couple of months ago. My financial conditions are fine enough for my studis but to apply for my spouse do I need to have money in my account or should it be sponsered from some one in Pakistan.
Hope some one will be able to help me.

Separation/divorce if I have indefinite leave
I came here in 2003 from Zimbabwe on the basis of indefinite leave as a dependant of my spouse who had been granted asylum. Now we are having problems big time and she wants separation and then divorce. Do I lose my indefinite leave status since I originally came on her account? Which rule or case law covers my situation?

However, I than went a consultant in Delhi who were very good and thorough professionals. They successfully got me the visa on the first attempt through their law firm in London. spouse visa
im married to my husband whos turkish we have been together for over 3 years in the uk and was due to marry here at the end of the year (got COA from homeoffice etc) a month after we booked the wedding they removed him form the uk (He came here with no visa 9 years ago, but was given a national insurance number and paid tax).
at the moment im recieving public funds but am applying or jobs (hopefully will get one in the next few weeks)then i wont recieve any public funding at all. as we are applyin for a spouse visa will it matter that i would of only been in the job for a few weeks.
my parents (who are fairly well off) have offered to write a letter saying if we ever did fall on hard times they would support us so we would need no help from public funding.
Does anyone know if this sounds like we have a good chance of gettin the visa smoothly???

hi chelea i think u have a great chance of getting the visa, did u get married offically?? when applying for the visa get some legal advice on the documents preparation but in your case its simple to get the papers together, its a good idea to get a supporing letter from your perants, only a few weeks of work is not good enough so make sure u at lease get 1 or 2 months payslip and a good employment letter confirmation from your employer. its good to add some profe of contact with your partner like pictures, text message profe, email...etc
please bear in mind that you also must show accomodation either at your perants home or elsewhere but it must not cause any overcrowding there must be enough room for you and your partner u should support this with tenancy agreement. also the other important factor is public funds u must not receive public funds and u must state that u r not intending to receiving public funds with your husband. you should show some savings but dont worry if u dont have much savings u can show someone as support financially. you should talk about this with someone professional.
in the meantime good luck im also turkish...

I'm married 2yrs to a UK cicitizen and have received my indefinite leave to remain visa already. We are going in for our 3rd year in Novemeber, what happens next do i remain on the indefinite visa? and do I qualify for a british passport now?

everybody my husband got the visa finallyyyy,,, i tell u what my case was the most difficult case its been spoken about by all law firms people are now using it as a way around their cases.. no ones can be as difficult as mine so dont worry too much and remember to always pray and ope it works...
